What Is Premises Liability?

Premises liability law holds property owners and occupiers legally responsible for injuries arising from unsafe or dangerous conditions on their property. These parties have a duty to maintain reasonably safe premises and warn visitors about hazards that aren't immediately obvious.

When property owners breach this duty by failing to repair known dangers, neglecting routine maintenance, or ignoring safety standards, they can be held liable for resulting injuries.

However, establishing liability requires proving the property owner knew or should have known about the dangerous condition, had a reasonable opportunity to fix it, and failed to take appropriate corrective action or provide adequate warning.

Types of Premises Liability Incidents

Premises liability cases can arise from:

  • Slip and fall accidents - Wet floors without warning signs, icy walkways, spilled liquids in stores, uneven surfaces, loose carpeting, or freshly waxed floors, causing victims to lose footing and suffer serious injuries.
  • Trip and fall accidents - Cracked sidewalks, broken stairs, uneven pavement, cluttered walkways, poor lighting obscuring hazards, or unexpected elevation changes causing people to trip and fall.
  • Inadequate security - Assaults, robberies, or violent crimes occurring on properties with insufficient security measures in areas where criminal activity was foreseeable based on prior incidents.
  • Structural failures - Collapsing stairs, balconies, railings, or ceilings due to poor maintenance, building code violations, or defective construction.
  • Negligent maintenance - Broken handrails, defective elevators or escalators, malfunctioning automatic doors, exposed wiring, or other maintenance failures creating dangers for visitors.
  • Swimming pool accidents - Drowning or near-drowning incidents due to inadequate supervision, missing safety equipment, broken gates or fencing, or failure to comply with pool safety regulations.
  • Dog bites - Injuries from animals on property where owners failed to properly restrain or warn about aggressive pets.
  • Toxic exposure - Mold, asbestos, lead paint, carbon monoxide, or other hazardous substances on properties where owners knew or should have known about contamination.
  • Falling objects - Items falling from shelves, merchandise displays, or improperly secured building materials injuring customers or visitors.
