The Workers Compensation Appeal Board issued a decision in BJ’s Wholesale Club v. W.C.A.B., No. 2010 C.D. 2011 (May 10, 2012). In this matter the WCAB issued an Order reversing the grant of total disability benefits since loss of earnings due to termination for misconduct was unrelated to injury as the claimant violated the employer’s substance abuse policy by reporting to work after an injury under the influence of alcohol.
