The Commonwealth Court recently issued a decision concerning an over the road truck driver who was insured out of state but lived in Pennsylvania in the matter of Williams v. W.C.A.B., No. 2422 C.D. 2009 (July 29, 2010). Typically this injured worker’s case would not be handled in Pennsylvania. However, the Court stated that if a substantial portion of your work time is in Pennsylvania then you have the right to file your claim in Pennsylvania. In this particular case the Court found that 38% of working time constitutes a substantial part of working time
