The Commonwealth Court issued a decision in Lewis v. U.C.B.R., No. 1552 C.D. 2011 (April 16, 2012) which was favorable to the claimant. In this case the Court ruled that benefits that had previously been denied be reinstated. The Court held that the prior decision be reversed when an alleged threatening confrontation with a co-worker in the workplace was in violation of employer policy but employer failed to identify a specific rule or policy allegedly violated or document evidence of such policy.
